Surprised everyone while making. After all the drama from morning till evening, Shiv Sena, NCP and Congress filed a petition in the Supreme Court at night requesting the cancellation of Maharashtra Governor's decision to administer oath of Chief Minister to BJP's Devendra Fadnavis. At the same time, it has also requested to conduct a 'power test' immediately to stop the horse-trading of MLAs.
On this petition, a bench of Justice NV Ramanna, Justice Ashok Bhushan and Justice Sanjeev Khanna will hear on Sunday in the Supreme Court. The hearing on this matter will begin at 11:30 in the apex court. The three parties also demanded a direction to Governor Bhagat Singh Koshyari to invite him to form the government under the leadership of Shiv Sena chief Uddhav Thackeray. It has also been said that he has the support of more than 144 MLAs.

The petitioners alleged that the governor acted 'discriminatoryly' and 'allowed himself to become a pawn in the capture of power by the BJP'. The three parties also requested for a power test immediately within 24 hours, so as to prevent illegal attempts to gain power in any way by breaking the horse-trading of MLAs and the Maha Vikas Aghadi (MVA).
The petition filed through Fadnavis claimed that the Governor's work to create a 'BJP-minority government' is illegal and unconstitutional. It further stated that the Shiv Sena, NCP and Congress coalition jointly have a 'clear majority' in the 288-member assembly and it is clear that the BJP does not 'have the required figure of 144 MLAs.' Fadnavis was invited to form the government. Seeking the cancellation of the decision to be made, the petition said that it was 'unconstitutional, arbitrary and illegal' and a violation of Article 14 of the Constitution. The Shiv Sena, NCP and Congress have filed a separate petition seeking direction to the Governor to call a special session to take the oath of legislators and test the power.
