In the case of Kulbhushan Jadhav, running in the International Judicial Court (ICJ), India wants an immediate release of Jadhav rather than any limited relief. But India's demand will depend on the extent to which its lawyers can satisfy the ICJ about the suspicious attitude of Pakistan's military justice system.

In such cases in the past, ICJ has asked most of the concerned country to revisit the judgment given about the mujrim. Although Jadhav's case is different from the ICJ cases, it was not under the more credible US Criminal Justice System (Criminal Justice System). For ICJ to reconsider its decision from the military court of Pakistan, it will be much less than the intention of India.

India's arguments turned into a question on Tuesday when former lawyer of international Geneva and ICJ's former law clerk Shashank Kumar said that limited relief is not justified in such a case, due to lack of fairness and proper procedure in Pakistan's military judicial system.

Pakistan has argued that the bilateral treaty that was signed with India in 2008 does not apply to Jadhav because Jadhav is a spy. Shashank Kumar says that the attitude of the bilateral treaty and the military justice system of Pakistan will be very important in this direction in the matter of providing relief to India from the International Court.
